Wage & Hour Rights and Responsibilities

Wage Payment: Employee rights consist of:- Pay for all wages earned (INFO # 3) at the rate accepted by the employer and staff member.

– Pay of at least base pay (INFO # 1), the relevant Colorado or local base pay, and all earned overtime incomes without impermissible reductions from their salaries;.

– Pay of all earned incomes without impermissible reductions (INFO # 16).

Labor Statutes, Rules, & Published Guidance

Statutes & Rules: DLSS implements a lot of Colorado’s wage and hour and other kinds of labor statutes and labor rules, consisting of the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Pay for Equal Work Act. Please check out the Division’s Labor Statutes and Labor Rules webpages for present and prior variations of key Colorado labor statutes and guidelines.

Published Guidance: The Division’s primary types of public assistance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s formally authorized notices, opinions, and descriptions on various labor law subjects; and.

– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for workers on their labor rights.

Written Demands, Complaints, & Investigations

Demands & Complaints for Wages: If a company owes you salaries, you can send your company a written demand for payment of wages by mail, e-mail, text message, or other electronic methods. A written demand may be sent out to the company at the very same time a Labor Standards Complaint Form for unpaid incomes is submitted with the Division. The Labor Standards Complaint Form can be discovered on our Demands, Complaints, employment Responses, and Settlements web page.

Employer Responses in Investigations: Once a complete Labor Standards Complaint Form is received and examined, a letter explaining the nature of the problem and the quantities declared to be owed is sent out to the company. Investigations Launched by the (” Direct Investigations”): The Division might conduct employer-wide direct examinations of possible violations of Colorado wage and hour law. If you want to file a private claim for overdue wages, you should complete a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements webpage. To appeal a direct investigation citation or one or more Notices of Assessment, a supposed employer might submit a Direct Investigation Appeal Form.
